In 2004, several disability advocacy groups filed a lawsuit against Archstone, Niles Bolton, contractors and other architects alleging that Archstone apartment buildings were not designed and constructed so that they would be accessible to persons with disabilities in compliance with the Fair Housing Act (FHA)

  • City Contract May Not Be Modified Orally or by Course of Dealing, Court Holds

    R&D Consultants, Inc., a civil engineering company, contracted with the City of Carlsbad, California, to redesign a municipal golf course for a fixed price of $556,745. The contract provided that it could be amended only by a written agreement signed by both parties. During construction, the parties entered into four written change orders, increasing the base contract price by $63,525.50.

    Piedmont Construction Group, LLC contracted with the Board of Regents of the University System of Georgia to renovate an historic building on the campus of Middle Georgia College. During the renovation, a plumbing subcontractor soldering pipes accidently ignited a wood wall stud, which destroyed the roof and the entire second floor of the building and caused extensive damage to the rest of the structure.

    A jury awarded plaintiffs Michael Sean Huitt, an experienced plumber, and Matt Nino, a plumber's assistant, each more than $1 million in compensatory damages and $5 million in punitive damages against Southern California Gas Co. for injuries they sustained while attempting to light a water heater at a construction site owned by the Porterville Unified School District.

  • Design Professional Denied Protection of Contract's Liability Limit by Florida Court

    A geologist's corporation contracted with a country club for consulting and project coordination services for a reverse osmosis water treatment plant. The plant, to provide irrigation water for the club's golf course, was to be designed and built by another company, ITT Industries, Inc.
